Ohio, Enough with Special Homosexual Rights Bill Already

Ohio Democrats in the House are back at again with one their yearly pro-homosexual rights bills. This time it’s HR 176, a bill which changes quite a number of sections within the Ohio Revised Code, making sure that everything there is government related doesn’t, can’t, or won’t discriminate because sexual orientation or gender identity.

You’ll note the number I have included that deal directly with public schools and schooling-right to heart of the matter- making sure our government run schools are open to anyone with a same sex attraction disorder, including pedophilia (see Sec. 4112.01). I wonder how many of Chris Redfern’s rank and file know this?

Here are a few stand outs among the many:

Sec. 124.93. (B) No health insuring corporation that, on or after July 1, 1993, enters into or renews a contract with the department of administrative services under section 124.82 of the Revised Code, because of a physician’s race, color, religion, sex, or national origin,; disability, sexual orientation, gender identity, or military status as those terms are defined in section 4112.01 of the Revised Code,; age,; or ancestry, shall refuse to contract with that physician for the provision of health care services under section 124.82 of the Revised Code.

Sec. 340.12. No board of alcohol, drug addiction, and mental health services or any agency, corporation, or association under contract with such a board shall discriminate in the provision of services under its authority, in employment, or contract on the basis of sexual orientation or gender identity as those terms are defined in section 4112.01 of the Revised Code, race, color, sex, creed, disability, or national origin.

Sec. 511.03. After an affirmative vote in an election held under sections 511.01 and 511.02 of the Revised Code, the board of township trustees may make all contracts necessary for the purchase of a site, and the erection, improvement, or enlargement of such building. The board shall have control of any town hall belonging to the township, and it may rent or lease all or part of any hall, lodge, or recreational facility belonging to the township, to any person or organization under terms the board considers proper, for which all rent shall be paid in advance or fully secured. In establishing the terms of any rental agreement or lease pursuant to this section, the board of township trustees may give preference to persons who are residents of or organizations that are headquartered in the township or that are charitable or fraternal in nature. All persons or organizations shall be treated on a like or similar basis, and no differentiation shall be made on the basis of sexual orientation or gender identity as those terms are defined in section 4112.01 of the Revised Code, race, color, religion, national origin, sex, or political affiliation. The rents received for such facilities may be used for their repair or improvement, and any balance shall be used for general township purposes.

Sec. 1501.012. (A) The director of natural resources may lease lands in state parks, as defined in section 1501.07 of the Revised Code, and contract for the construction and operation of public service facilities, as mentioned in that section, and for major renovation or remodeling of existing public service facilities by the lessees on those lands. …(9) A requirement that the public service facility be available to all members of the public without regard to sex, race, color, creed, ancestry, or national origin,; or disability, sexual orientation, or gender identity, as those terms are defined in section 4112.01 of the Revised Code;

Sec. 2927.03
. (A) No person, whether or not acting under color of law, shall by force or threat of force willfully injure, intimidate, or interfere with, or attempt to injure, intimidate, or interfere with, any of the following:

(1) Any person because of race, color, religion, sex, national origin, or ancestry; or familial status as defined in section 4112.01 of the Revised Code, national origin, military status as defined in that section, disability as defined in that section, gender identity, or ancestry sexual orientation, as those terms are defined in section 4112.01 of the Revised Code, and because that person is or has been selling, purchasing, renting, financing, occupying, contracting, or negotiating for the sale, purchase, rental, financing, or occupation of any housing accommodations, or applying for or participating in any service, organization, or facility relating to the business of selling or renting housing accommodations;

Sec. 3113.36. (A) To qualify for funds under section 3113.35 of the Revised Code, a shelter for victims of domestic violence shall meet all of the following requirements:

(B) A shelter for victims of domestic violence does not qualify for funds if it discriminates in its admissions or provision of services on the basis of sexual orientation or gender identity as those terms are defined in section 4112.01 of the Revised Code, race, religion, color, age, marital status, national origin, or ancestry. A shelter does not qualify for funds in the second half of any year if its application projects the provision of residential service and such service has not been provided in the first half of that year; such a shelter does not qualify for funds in the following year.

Sec. 3301.53. (A) The state board of education, in consultation with the director of job and family services, shall formulate and prescribe by rule adopted under Chapter 119. of the Revised Code minimum standards to be applied to preschool programs operated by school district boards of education, county MR/DD boards, or eligible nonpublic schools. The rules shall include the following:

(3) Standards ensuring that preschool staff members and nonteaching employees are recruited, employed, assigned, evaluated, and provided inservice education without discrimination on the basis of sexual orientation or gender identity as those terms are defined in section 4112.01 of the Revised Code, age, color, national origin, race, or sex; and that preschool staff members and nonteaching employees are assigned responsibilities in accordance with written position descriptions commensurate with their training and experience;

Sec. 3313.481. (A) With the approval of the department of education, a board of education of a city, exempted village, local, or joint vocational school district may operate any of its schools on a schedule other than that required by section 3313.48 of the Revised Code in order to do any of the following:

C) No board of education shall discriminate on the basis of sexual orientation or gender identity as those terms are defined in section 4112.01 of the Revised Code, sex, race, religion, or national origin when assigning pupils to attendance schedules pursuant to this section.

Sec. 3314.06. The governing authority of each community school established under this chapter shall adopt admission procedures that specify the following:

(D)(1) That there will be no discrimination in the admission of students to the school on the basis of sexual orientation or gender identity as those terms are defined in section 4112.01 of the Revised Code, race, creed, color, disability, or sex except that:

Sec. 4112.01. (A) As used in this chapter:

(2) “Employer” includes the state, any political subdivision of the state, any person employing four or more persons within the state, and any person acting directly or indirectly in the interest of an employer, except that for purposes of discrimination based upon sexual orientation or gender identity, “employer” includes the state, any political subdivision of the state, any person employing fifteen or more persons within the state, and any person acting directly or indirectly in the interest of an employer.

(b) “Physical or mental impairment” does not include any of the following:

(i) Homosexuality and bisexuality;

(ii) Transvestism, transsexualism, pedophilia, exhibitionism, voyeurism, gender identity disorders not resulting from physical impairments, or other sexual behavior disorders;

(23) “Sexual orientation” means actual or perceived, heterosexuality, homosexuality, or bisexuality.

(24) “Gender identity” means the gender-related identity, appearance, or mannerisms or other gender-related characteristics of an individual, with or without regard to the individual’s designated sex at birth.

Ohio Livestock Care Standards Board

I was a little slow yesterday getting the information posted concerning a state joint resolution being considered by the Ohio General Assembly, which was passed yesterday. Andy Vance has two postings (here and here) about the measure and his perspective concerning the possible regulation, which differs from that of Suzana Megles.

The measure as described by Andy Vance:

The joint resolutions propose a ballot measure that would create the Ohio Livestock Care Standards Board, a 13-member state board that would determine and enforce guidelines for the care and well being of livestock and poultry in Ohio in order to protect food safety and locally produced food for Ohioans.

I see a couple of points worth considering, which will have to be considered by all of us considering this measure will be presented to us on the next ballot.

Initially, Miss Megles is spot on concerning the care of, and cruelty toward, livestock. I believe, as many Ohioans, that we are stewards of the earth and given domain to care for God’s creature by Him. Farming comes with a great responsibility to both the animals and consumers, and we must guard this responsibility.

On the flipside Mr. Vance is entirely correct in his assessment concerning the HSUS and PETA. Their agenda, to stop all animal husbandry practices, is masked behind the veil of animal cruelty protection. They are completely duplicitous.

This leads into the third aspect, the citizen’s board created by the resolution. Ms. Megles points out that if the resolution is passed it’s likely that big agro-business will have a seat on the board and will be able protect those farms that have in the past been guilty of such scandalous actions. She is right, and history is complete with volumes of examples of business/government collusion in which the citizen/consumer ends up being short changed or worst, injured.

Mr. Vance on the other hand views the board as preventive measure, which ensures Ohio citizens are able create the codes that will fairly govern the producer while protecting the consumer, which if led properly, can serve Ohio well. Further, Mr. Vance sees the role of the board as a filter to keep out the agenda driven groups like HSUS and PETA that will, if given a chance, drive us toward a vegan life style; which is true also.

The final concern discussed and acknowledged by Mr. Vance and also a commenter on his site recognizes the loss of private property protection and limited government aspect. Mr. Vance acknowledges that this creates another layer of government, but believes this measure is important to protect the Ohio citizen. At the moment I tend to disagree, however, Mr. Vance does raise some very prudent reasons, which may transcend this civil liberty. I would certainly feel a bit more comfortable with oversight from the state rather than the federal government, which is where PETA and HSUS will put their efforts. But on the other hand Ohio’s lawmakers during the last 20 or so years have done such dismal job legislating, which resulted in stifling atmosphere of maddening business regulations, our business sector has become the worst in the country. I certainly don’t want that for our agricultural sector.

Well the decision is squarely in the hands of the citizenry, and I can tell you I cannot see a clear path to take. And if I as small farmer can’t see the correct path how the heck is the person in Columbus or Cincinnati, who has no stake in this because 99 percent of their foodstuff comes from out of state, is going to make the right decision.

Maybe if this was one part of great plan to re-energize Ohio’s local food producers I would feel comfortable with the state regulating me, but knowing it’s not, I’m inclined to be extremely cautious. We will see.

Big Ag to Police its Animal Treatment in Ohio

Just some short snippets from the larger article. Also, I running a bit behind today, but I am going to follow-up with some additional information about this Ohio bill.

This week both HSUS and Farm Sanctuary warned Ohioans of Big Agribusiness lobbying to have legislation introduced which would amend the state constitution to give industry oversight over the well-being of farm animals. The legislation: Senate Joint Resolution NO.6/House Joint Resolution No.2.

Per Farm Sanctuary: “This is a transparent attempt to hijack the constitution to the detriment of farm animals across the state, as well as the basic democratic processes. It’s crucial that we (Ohioans) thwart this effort by Big Agribusiness to be the only voice in deciding how farm animals are treated and to evade broadly-supported efforts to outlaw the cruelest factory farming practices, including confining animals in crates so small they can’t even turn around or spread their limbs.” (And in the case of caged chickens – their wings.)

Pot War Senseless

Check out this interesting letter to the editor in the Boston Herald, with a great quote from Lincoln:

The article about legalizing marijuana was seriously misnamed (“Pot legalization efforts gain momentum in U.S.,” June 16). It should have been about the relegalization of pot. The hemp plant has been used for thousands of years for medicinal and industrial purposes. But it was the Marijuana Tax Act of 1937 that sounded the death knell of this multipurpose plant. And this bill was passed on politics, greed and blatant racism. Not on medical or scientific fact.

I’m not condoning drug use, but when the alleged cure for a disease is worse than the disease itself, alternatives should at least be considered. Abraham Lincoln said, “A prohibition law strikes at the very principles upon which our government was founded, for it goes beyond the bounds of reason in that it attempts to control a man’s appetite by legislation, and makes a crime out of things that are not crimes.”

Time for a drug peace.

No Nose Holding for Husted

Matt Hurley has a worthy comment about Ohio Republican Party’s version of the Breck Girl, Jon Husted,

Establishment Republicans like to think that the problems with the brand here in Ohio is solely the concern of former Governor Bob Taft but I think it goes beyond just that. Ohioans are fed up with the business-as-usual attitude that the Taft era politicans gave us and Jon Husted was a member of leadership at that time, so he is just as guilty as anybody. Does anybody really think that Chris Redfern and the Democrats won’t use Taft’s Speaker Husted as a prop for saying that the Ohio GOP hasn’t changed? I can see that ad already…and the Facebook, Yahoo, and Google splashes too…

What does Jon Husted offer besides more headaches? This is a legitimate question I am asking here…

No nose holding here; I will not vote for Husted, and will certainly vote for one of the socialist democrats that have taken over the state simply because it’s the same thing as voting for Husted. At least I know with one Redfern’s socialists I am going to get screwed. With Husted it’s all Rush Limbaugh talk, and then the prison intercourse.

Here’s a challenge for you. Go to any leftist weblog and read the postings about Iran and then do the same thing on a neo-con site. I’ll bet you’ll see no difference in rhetoric. Why aren’t leftist and neo-cons concerned about Sudan, Venezuela or Zimbabwe, where life is significantly worst? Here’s why; both are conditioned to respond to the government media complex anytime their cages are rattled. At the end of the day both democrat socialists and republican neo-cons are imperialists, both are statists, and both care nothing about liberty and freedom.

Sell the Farm, Kasich Wins!

I can’t believe we are this far out from the state gubernatorial election and some folks think Kasich is a shoe in. Well I wouldn’t bet the farm on it yet.

This race is shaping up to be a war between the New York financiers that screwed this country out of trillions, i.e. John Kasich fascist supporters, and the Washington socialists that have allowed the New York financiers to screw this country, i.e. Ted Strickland leftist supporters, and with no one supporting Ohio. Wonderful!

No, I’ll wait and see for now, and pray for a third party candidate or at the very least, someone that calls Ohio home.
